  Randall Gilbert:

Randy GilbertRandall Gilbert, Esq. a native Floridian, is a senior partner with the law firm of Gilbert Law Group PA.  Prior to embarking on his law career he worked as a Certified Master Plumber. Mr. Gilbert received his Juris Doctorate from Nova Southeastern University, Shepard Broad Law Center was a recipient of the National Institute of Trial Advocacy Award, has argued cases to the Supreme Court of Florida and District Court of Appeal. 

Mr. Gilbert is admitted to practice in all state courts of Florida, as well as in the Federal Courts for the Southern and Northern Districts of Florida.  Mr. Gilbert is a member of the Broward County Construction Lawyer's Association (Vice Chairman); Broward County Bar Association; Director of the North Dade Chamber of Commerce; and achieved the highest recognition as one of the first Board Certified Construction Litigators in this State.

Mr. Gilbert’s practice is based in litigation in the state and federal court systems, including appeals with emphasis in Construction Litigation; Commercial Litigation; Contracts; and Corporate law.  Mr. Gilbert primarily counsels the construction industry dealing with State and Federal litigation and arbitration. Typical claims handled by Mr. Gilbert include licensure, construction liens and bonds, DBPR complaints, bidding, delays, defects, contract preparation and negotiation.  

Civil / Public Works Construction Cases – Exemplars

1.   Florida Paving and Trucking v. Concrete Works and Pavers, LLC and Travelers Casualty and Surety Co. of America.  Representation of Florida Paving in its breach of contract and FL.ST. 255.05 bond claims against Concrete Works and its surety for the “milling-out” and reinstallation of asphalt roads on a project for the improvement of Coral Way (The Miracle Mile) in Coral Gables, FL.  The case settled on terms favorable to Florida Paving.

2.   Florida Power and Light, Co. v. Mancon, Inc. Successful defense of Mancon in its attempt to reduce its exposure to FPL in connection with a significant claim for damage caused to FPL’S underground utilities in a Florida statutory Underground Utilities Act case.  As a result of the defense, Mancon’s liability was capped to approximately $4000 at trial.  Further, Mancon narrowly missed obtaining a net Judgment against FPL for its attorney’s fees, by virtue of the service of a Proposal for Settlement/Offer of Judgment served on FPL.

3.    Gene Contracting Demolition, Inc. vs. Adams-Robinson Enterprises, Inc., and Travelers Casualty & Surety Company of America.  Representation of Gene Contracting in connection with a subcontract dispute with the general contractor and a FL.ST. 255.05 bond claim against its surety concerning a project for improvements to the Iron Bridge in Orlando, Florida, Job Number: 20309.  The case is pending and has not yet been set for trial.

4.   Gene Contracting Demolition, Inc. adv. Myers Construction Group, Inc., The Poole and Kent Company and St. Paul/Travelers Ins. Co.  Representation of Gene Contracting in connection with a subcontract payment dispute and a FL.ST. 255.05 bond claim against the surety concerning a project for improvements to the City of Fort Lauderdale’s Fiveash Water Treatment Plant.  The case settled pre-suit on terms favorable to Gene Contracting.

5.   R. Meunier & Sons Contracting, Inc. adv. Myers Construction Group, Inc., The Poole and Kent Company and St. Paul/Travelers Ins. Co.  Representation of R. Meunier in connection with a subcontract payment dispute and a FL.ST. 255.05 bond claim against the surety concerning the City of North Miami Beach’s Norwood-Oeffler Water Treatment Plant upgrades project.  This matter settled pre-suit on terms favorable to R. Meunier.

6.   McClain and Co. v. Hypower, Inc and USF&G.  I represented McClain (subcontractor) in its FL.ST. 255.05 bond claim against Hypower and its surety in regard to Orange County Expressway, OOCEA Project No. 276, All Segments where McClain furnished and installed fiber optic and other cables on a large section of public highway and bridges.  The case settled during discovery on terms favorable to McClain.

7.   South Florida Construction Services, Inc. v. The City of Boca Raton v. Slattery and Associates, Inc., et. al.  Representation of SFCS in a payment dispute with the City where  interference and negligence claims have been asserted against the design professionals, on a 9 Million dollar public library project for the City.  The case is pending and has not yet been set for trial. 

8. South Florida Construction Services, Inc. v. Broward County, Scharf and Associates, Inc. and Derose and Slopey Consulting Engineers, Inc.  Representation of SFCS in a payment dispute with the County in connection with the construction of Terminal 21 at Port Everglades, FL.  SFCS also asserted breach of implied warranty of plans and specifications and negligence claims against the design professionals. SFCS further asserted bad faith against the County in its failure to pay which resulted in SFCS suffering diminished bonding capacity preventing it from bidding on public work.  The case settled shortly before trial on terms favorable to SFCS.

9. East Coast Paving v. Liberty Mutual Insurance Co.  Representation of Liberty Mutual, (surety) in the successful defense of a FL.ST. 255.05 bond claim filed by a subcontractor to the bond’s principal, on a public works and road project in downtown West Palm Beach, Florida.  After a year and a half of contested litigation, the case was dismissed and all of the surety’s attorney’s fees were paid for by the adverse party.

  Bryce Gilbert :

Bryce Gilbert Bryce Gilbert, a native Floridian, is a junior associate with the law firm of Gilbert , P.A.  Bryce Gilbert is a Certified Master Plumber and a Certified Utility and Excavation Contractor.  He received his Juris Doctorate from Nova Southeastern University, Shepard Broad Law Center. 

Bryce Gilbert’s practice is based in litigation in the State of Florida and he focuses his practice in the areas of Construction law, Contract Law, and Employment Law.  He also deals in the preparation and execution of evidentiary presentations, computers, computer graphics, image enhancement, electronic presentations and displays for trial preparation and courtroom viewing.
